Terms of Service

1. Acceptance of Terms

By accessing or using HeyDopple ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. These Terms apply to all users, including visitors, registered users, and premium subscribers.

2. Description of Service

HeyDopple is an AI-powered platform that enables users to create personalized AI assistants ("Dopples") based on their professional expertise, documents, and knowledge. The Service allows users to upload content, create AI representations, share Dopples publicly or privately, and access analytics.

3. User Accounts and Registration

  • You must be at least 18 years old to use the Service
  • You are responsible for maintaining the confidentiality of your account credentials
  • You agree to provide accurate, current, and complete information during registration
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree NOT to:

  • Upload content that is illegal, harmful, threatening, abusive, or violates any laws
  • Upload content that infringes on intellectual property rights of others
  • Use the Service to create Dopples that impersonate others without permission
  • Upload malicious software, viruses, or code designed to damage or disrupt systems
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Use the Service for spam, harassment, or any form of abusive behavior
  • Reverse engineer, decompile, or attempt to extract source code from the Service
  • Use automated systems to access the Service without permission
  • Resell or redistribute the Service without our written consent

5. User Content and Intellectual Property

5.1 Your Content

You retain all ownership rights to the content you upload to HeyDopple. By uploading content, you grant us a limited, non-exclusive license to use, store, and process your content solely to provide and improve the Service.

5.2 Content Ownership

The HeyDopple platform, including all software, designs, logos, and trademarks, is owned by HeyDopple and protected by intellectual property laws. You may not copy, modify, or create derivative works without our written permission.

5.3 AI Model Training

We do not use your private content to train general AI models. Your content is used exclusively to create and personalize your Dopple.

6. Subscription and Payment

  • Free and Pro subscription plans are available
  • We reserve the right to modify, add, or remove features from any subscription tier, including the free tier, at any time. Features that were previously available in the free tier may be moved to Pro or other paid tiers.
  • Subscription fees are charged in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law or at our discretion
  • We reserve the right to change pricing with 30 days' notice to existing subscribers
  • Failure to pay may result in suspension or termination of your account
  • You can cancel your subscription at any time, with access continuing until the end of the billing period

7. Service Availability and Modifications

We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. We reserve the right to:

  • Modify, suspend, or discontinue any aspect of the Service at any time
  • Perform maintenance that may temporarily interrupt service
  • Update features, remove features, or change functionality

We will provide reasonable notice of significant changes that affect your use of the Service.

8. Termination

You may terminate your account at any time. We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any reason with or without notice. Upon termination:

  • Your right to use the Service immediately ceases
  • You may export your data before termination
  • We may delete your account and content after a reasonable retention period

9. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We are not responsible for:

  • Accuracy, completeness, or reliability of AI-generated responses
  • Loss or corruption of data
  • Unauthorized access to your account or content
  • Third-party services or websites linked from our Service

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEYDOPPLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

10. Indemnification

You agree to indemnify and hold HeyDopple harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content you upload or create through the Service

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or prominent notice on the Service. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
